The Supreme People's Court has rejected Nian Bin's appeal for 5.4 million yuan in compensation from the state, reported China Youth Daily. Nian served 8 years on death row before being acquitted of the crime and released in August of 2014.

In December of 2014, Nian filed a claim for over 15 million yuan (around 2.4 million USD). The High People's Court in Fujian province ruled the next year that Nian should instead receive only 1.19 million yuan, including 640,000 yuan for loss of freedom and 550,000 yuan for mental suffering.

Nian appealed that decision to the Supreme People's Court, which accepted the case in February of last year.

The higher court has ruled that the Intermediate People's Court in Fuzhou does not need to pay any additional compensation to Nian as his right to life and health has not been violated, saying the decision is in compliance with state laws on compensation.

But Nian's older sister, Nian Jianlan, has told reporters that her brother now suffers a disability to one of his legs as a direct result of wearing fetters during his captivity.

She added that the 1.19 million yuan compensation was scarcely enough for her family to pay the debts that came from the cost for Nian's treatment, lawyers' fees and other costs.

Nian's appeal for the public security authorities to remove his name as a criminal suspect was also rejected by the Supreme People's Court. Nian was again listed as criminal suspect by the public security authority of Fujian province just 9 days after he was acquitted by the province's higher court, according to the China Youth Daily report.

Nian was arrested in 2006 after two of his neighbours in Pingtan, Fujian province, died from food poisoning. Nian was handed a death sentence for murder after a fourth trial. On three previous occasions, retrials were ordered due to lack of evidence.

Nian is the first person to appeal to the Supreme People's Court in China for higher stat
